Scott M. Kidwell is a shareholder who joined
the firm in 2002. His practice is concentrated primarily in the area of
litigation.Kidwell has had the
privilege to represent many clients in a wide variety of cases. Kidwell has
successfully represented major oil companies in ground water contamination,
surface damage actions, bad faith trespass and title disputes. Kidwell has also
assisted in the successful defense of a royalty owners’ class action.
Additionally, Kidwell has also successfully represented business entities of
various sizes in contractual and other disputes. Kidwell has represented major
insurance companies in contractual and extra-contractual claims. Additionally,
Kidwell has also represented large and small companies in various employment
related matters including the defense of ADA, ADEA and sexual harassment
claims. Further, Kidwell has a broad range of experience in the defense of
general liability claims. Kidwell has also had the privilege to represent many
physicians, clinics and hospitals as well as their professional associations in
the defense of various mal-practice claims. Kidwell has also had experience in
the Texas appellate courts where he has achieved favorable decisions on behalf
of his clients. Kidwell has spoken to groups on various civil litigation
defense issues.
Kidwell served as district
director for the Texas Association of Defense Counsel from 1999 until 2003. He
is a former Vice President of the Midland County Young Lawyers Association. He
was admitted in 1992 to the State Bar of Texas and is also a member of the
Midland County Bar Association, Midland County Young Lawyers Association and
Defense Research Institute.
In addition to his professional work, Kidwell
has been involved in the civic life of Midland. He is currently serving on the
Board of Directors of the Midland Children’s Rehabilitation Center as well as
sitting on the Adversary Board of the Texas Tech Health Science Center.
Kidwell received his BBA from Texas Tech
University in 1989 and his law degree from the Texas Tech University School of
Law in 1992. He is licensed by the Supreme Court of Texas, the United States
Court of Appeals for the Fifth Circuit, and the United States District Courts
for the Western, Northern and Southern Districts of Texas.
