Steve Kiser is a shareholder who joined
the firm in 1980 and whose principal areas of practice are appellate, trial, and
alternative dispute resolution. He is Board Certified in Civil Trial Law by the
Texas Board of Legal Specialization and has served as a mediator in a wide
variety of civil disputes, having conducted more than two hundred and fifty mediations.
Kiser has broad experience in oil and gas
litigation having represented clients in suits involving gas purchase
agreements, joint operating agreements, operator/royalty owner disputes
including royalty owners class action suits, lease access disputes, lease
construction issues, drilling contracts, mechanic’s and materialman’s lien
claims, COPAS accounting issues, environmental and water contamination claims,
operator removal disputes, surface use and damages claims, trespass claims,
take-or-pay agreements, area of mutual interest agreements, preferential right
to purchase agreements, and other industry-related agreements.
Kiser has also represented clients in
litigation in numerous other areas including will contests, shareholder
litigation, personal injury claims, will contests, and a large range of
commercial disputes involving claims of tortious interference, fraud, negligent
misrepresentation, DTPA, and breach of fiduciary duty.
Kiser has served as appellate counsel in a
large number of appeals in both state and federal courts. In addition to serving
as counsel for appellants and appellees in appeals from both jury and bench
trials, Kiser has represented clients in interlocutory appeals relating to the
granting and denial of temporary injunctions and class certification issues, and
has sought mandamus and other ancillary relief and filed or defended numerous
petitions for review in the Texas Supreme Court.
Kiser is a frequent speaker at seminars on
topics including, oil and gas, trial and appellate, employment law, and
alternative dispute resolution. In addition, as the firm’s primary appellate
attorney, he consults with the firm’s other trial attorneys on motions, briefs,
and the jury charge.
Kiser has been active in the community, serving
on a number of boards, holding board offices, and chairing capital campaigns. He
is currently serving his fourth term as a Trustee of Midland College, having
first been elected in 1986.
Kiser is a graduate of Texas A&M University
(B.A. 1977) and Baylor University School of Law (J.D. 1980). He is licensed by
the Supreme Court of Texas, United States Supreme Court, the United States Court
of Appeals for the Fifth Circuit and the United States District Courts for the
Western, Northern and Southern Districts of Texas.
