Derek Cook Bio

Derek is a Shareholder in LCA’s trial section handling lawsuits and appeals involving oil and gas, commercial disputes, real estate, personal injury, and creditor’s rights.  Derek is a Past President of the Midland County Bar Association and served as the Director for District 16 on the Board of Directors of the State Bar of Texas. Beyond his formal bar service, Derek is devoted to providing pro bono legal services in civil matters, working with youth through serving as a board member and volunteer judge for Midland Teen Court, and advocating for and working with lawyers and others suffering with mental health and addiction issues.  Derek, an excellent communicator, has published legal related articles, continuing legal education papers, and is a frequent speaker on legal issues and attorney wellness.

Derek and his wife, Carly, have made Midland their home since 2011 along with their two children, Nolan and Nora.

Trial Experience
  • Obtained $1.9 million jury verdict in Ector County, Texas, including $1 million in punitive damages, against an approximately $14 billion publicly traded equipment resale and auctioneering company based on findings of conversion and gross negligence by a vice principal of the corporation.
  • Received directed verdict for independent energy exploration company in jury trial related to $1.2 million in claims of gas royalty underpayments.
  • Second chaired 3-day jury trial related to claims of oil and gas lease termination and the applicability of the temporary cessation of production doctrine and defended take-nothing judgment as lead appellate counsel.
  • Received highly favorable defense verdict in Midland County jury trial where plaintiff alleged unlawful termination during the COVID-19 pandemic under the federal EPSLA.
  • Presented appellate oral argument before Fifth Circuit and Eastland Courts of Appeals.
  • Attends court hearings throughout the Permian Basin to present evidence and argument related to miscellaneous civil motions, including motions for summary judgment, applications for temporary restraining orders and injunctions, and various other pre-trial motions.
